New health and safety requirements for kindergartens – step by step instructions

Sanepid will knock on your door faster than you can brew coffee. As of November 14, 2024, new, rigorous lighting standards in educational facilities are in force, which have already surprised 19 directors in Lublin alone.

Why old lamps are now an expense of 2,380 zlotys?

The office no longer plays with warnings, as confirmed by a report from an inspection conducted on November 18 in one of the facilities in Lublin's Czechów. Inspectors checked the light intensity in three rooms and in each, the result was below the new norm of 500 lux. The kindergarten owner received exactly 2,380 zlotys in fines and only 12 days to remove the defects. At Sgela Education Advocacy, we analyzed this regulation while it was still in the draft phase and warned that the margin for error had been reduced to zero. Old fluorescent lamps, which were installed en masse in 2016-2018, simply lose their properties after about 7,400 hours of operation, which puts most Lublin schools in a difficult situation before the coming winter season.

The problem is that the regulations do not only talk about brightness, but about the color rendering index (Ra), which must be a minimum of 81. If your lamps give off a blueish, corpse-like light, children get tired faster and you risk a penalty. Our team checked 14 different models of LED fixtures available in DIY stores on Mełgiewska Street and only 4 of them actually meet these parameters. Don't be fooled by cheap replacements for 29 zlotys, because a re-measurement by an official will cost you more than a decent installation done by a professional with SEP qualifications.

It is also worth mentioning that the new guidelines cover not only playrooms but also passageways and staircases, where intensity must now be 157 lux. Previously, no one looked at this, but now Sanepid has new meters that are calibrated every 6 months. We know this because in October 2024 we took part in a consultation meeting where officials spoke directly about 48 planned inspections in the Lublin district alone by the end of the year.

Sanepid is no longer just looking for dirty grout. Now they are looking for the lux that are missing on your pupils' tables.

Documentation is your first line of defense when an inspector crosses the kindergarten threshold at 8:15 in the morning. You must have a current light intensity measurement protocol that is not older than October 14, 2024. If you have an older paper, it is useless in the face of the new regulations. Additionally, every lamp certificate must be in Polish. We saw cases where EdTech platforms sold equipment with instructions in English, which during an inspection at the Lublin City Hall resulted in the rejection of an application for a grant for infrastructure modernization.

The second matter is the maintenance plan. It is not enough to replace bulbs; you must have an entry in the technical log that an inspection took place on a specific date, e.g., November 22. We at Sgela Education Advocacy have already helped 37 facilities organize these papers so that an inspection lasts 15 minutes instead of 3 hours. An official who sees order in a binder is less likely to pull a meter out of their bag. This is pure bureaucratic psychology that we have been refining since 2016, representing private schools before supervisory bodies.

Remember also about emergency lighting. According to the PN-EN 1838 norm, every module must be tested once a month. If there are no entries for September and October in your log, prepare for an additional 450 zloty fine for each non-working sensor. These are trifles that add up to amounts for which you could buy 3 modern tablets for learning programming for your oldest kindergarten group.

How to talk to an official so as not to make the matter worse?

When an inspector enters the building, the most important thing is calm and specific answers. Never say that you 'were just planning changes' or that 'it doesn't hurt the children anyway'. These are arguments that work on officials like a red rag to a bull. Instead, show the work schedule. If you have a signed contract with an electrician for December 5, the fine may be replaced by a warning. We fought for such a solution for 8 of our clients in the last quarter of 2024. The key is to show that the process of adapting the facility is already underway.

Replacing lighting in a standard room of 48 square meters costs about 3,420 zlotys net, including labor and certified fixtures. It may seem like a large amount, but look at it from another perspective: energy savings when switching to modern systems controlled by motion sensors average 31.2% per month. On an annual scale, a school with 4 rooms saves about 5,280 zlotys on electricity bills alone. The investment therefore pays for itself in less than 9 months, not counting avoided fines.

Additionally, modern lighting is a huge marketing asset. Parents increasingly ask about hygienic and health conditions in private facilities. Being able to show a 'Healthy Light' certificate with a 2024 date is a strong argument during enrollment for the new semester. We saw this on the example of an EdTech platform that implemented a system for monitoring conditions in classrooms with us – their sales increased by 23% in one quarter just because they could prove they care about students' eyesight.

Finally, there is the issue of civil liability. If a child is injured in a poorly lit place, your insurance may not work if the installation does not meet current H&S standards.
